Mr. Sterne points out that one big defect with the current inter partes reexamination process is that there is no interview right. He says, “The examiners in the Central Reexamination Unit do not have the benefit of being able to ask needed questions and obtain needed information from either party in the reexamination. While the PTO has recently indicated some interest in creating an interview right, this may not occur due to the current fee diversion problems that the Office is experiencing.”

Recently, when the Federal Circuit has had a chance to restate the patent law as it applies to design patents, they seize the opportunity to reevaluate even long-standing precedent. However, in the recent decision in Vanguard Identification Systems Inc. v. Kappos and Bank of America Corp., the court let stand the very high bar to prove the obviousness of a design. The Vanguard case also represents the first time the Federal Circuit has reviewed a decision by the board arising out of an inter partes re-examination, raising the issue of the standard of review.
