The hour-long discussion focused on the rapidly developing area of patent reexamination within the United States. The material for the discussion was taken from Sterne’s ongoing reexam cases, as well as the his role in authoring Reexamination Practice with Concurrent District Court Litigation or Section 337 USITC Investigations. This paper is considered a go-to guide on reexams, published by The Sedona Conference. Evens and Pickard, members of the firm’s Litigation team, spoke to the differences between patent reexamination and district court litigation, providing insight on how SKGF is using both to leverage the best outcome for clients.
The presentation concluded in a question and answer session with the audience. Students and attendees asked pointed questions to Sterne, Evans and Pickard about current reexam cases, the future impact of patent reexamination in intellectual property law, and the advantages and disadvantages of reexamination over litigation. Students also asked Evens and Pickard detailed questions regarding their career choice to focus on patent litigation rather than general litigation.
