On October 23, 2009, Judge Marsha J. Pechman granted a motion to stay proceedings pending ex parte reexamination of the patents-in-suit in the District Court for the Western District of Washington in the matter of National Products, Inc. v. Gamber-Johnson, LLC.   The case involves U.S. Patent No. 7,573,706.   The patent issued on August 11, 2009, and on the same date, Gamber-Johnson filed an ex parte request for reexamination.    The Court determined that a stay was proper.  The Court provided no basis for its decision, other than noting the above facts regarding the patent issue date and the reexamination request filing date.
